Matter is listed for consideration.
On the LDOH, petitioner was directed to file legible and translated copies of page
no.26 and 27 which appear to be in Urdu language. Thereafter, an application under order XIII
Rule 1 CPC has been filed on behalf of petitioners seeking to place on record another rent receipt
filed as Annexure-A1 alongwith the translated copy and copy of rent deposit alongwith voucher
of rent deposited by respondent in 2008 as Annexure-A3.
It is stated that due to
bonafide mistake, earlier page no.26 and 27 i.e. rent receipts
were filed by the petitioners in respect of H. No. 147, Motia Mahal, Jama Masjid, Delhi-110006
whereas the tenanted premises is property bearing no.148.
Accordingly, it is prayed by the petitioners page no.26 and 27 be taken off the
record and rather the aforesaid documents pertaining to the property in question be taken on the
record.
Heard.
Matter is at initial stage and summons have not been issued and hence no prejudice
would be caused to the petitioner if the application is allowed. Hence, application under Order
XIII Rule 1 CPC stands allowed subject to cost of Rs.2,000/- to be deposited by the petitioners
with DLSA, Central, THC. Let receipt thereof be filed within two weeks from today.
On filing of PF and RC within seven days from today, issue notice of present
petition to the respondents for service upon them returnable on NDOH i.e. 26.04.2025.
