Present :- Sh. Ashok Kumar, Ld. Counsel for petitioner
alongwith petitioner.
Today counsel for petitioner has drawn the attention
of the court to the judgment dt. 10.01.2002 passed by the then
Civil Judge, Delhi in the suit filed by the father of the petitioner
against the same respondent, wherein the court had given the
finding with respect to the ownership of the father of the
petitioner in the same property.
Accordingly at this stage, I am duly satisfied with
the aspect of ownership of petitioner in the property in question.
As mentioned in the last order, the summon issued
to the respondent received back with the report that she was not
residing at the given address and some other person was found
there. Today it is further submitted on behalf of petitioner that
respondent had already left the tenanted premises as mentioned
in the eviction petition itself. Accordingly, request is made for
service of respondent through publication.
Upon oral request of counsel for petitioner and in
view of report on the summons, the service be effected by way of
publication in the newspaper “ Veer Arjun” on filing of PF.
Copy of publication be given dasti.
Now file be put up on 12.12.2025 for further
proceedings.
