Present : Ld. Counsel for petitioners.
An application under Order I Rule 10 CPC read with Order VI Rule 17 CPC
has been filed on behalf of petitioners on 06.05.2025.
It is stated that the only amendment sought by the petitioners is that
respondent no.2 / Ld. Presiding Officer, MACT, Central, THC is sought to be deleted as
it is stated that such party was inadvertently added by the petitioners.
It is quite apparent that there was no requirement of respondent no.2 in the
present case at hand and for such purpose, repeated opportunities were given to the
petitioners. Be that as it may, the application has been perused and for the reasons stated
therein, the application under Order I Rule 10 read with Order VI Rule 17 CPC is hereby
allowed subject to cost of Rs.2,500/- to be deposited by the petitioners in the A/c of
District & Sessions Courts Employees Welfare Association Delhi detailed as under:-

Receipt of the same be filed before NDOH.
Amended memo of parties and amended petition filed by the petitioners. Be
taken on record.
Petitioner is directed to disclose the details of wife and mother of the
deceased Sh. Prabhu Dayal on the NDOH.

On filing of PF and RC within seven days from today, issue notice of
present petitioner to the SDM concerned to appear on the NDOH alongwith Surviving
Member Certificate of the deceased.
On filing of PF and RC within seven days from today, issue notice of
present petition to the branch Manager of respondent no.2 bank / Union Bank of India to
appear on the NDOH alongwith statement of accounts of the deceased.
Be put up for 21.08.2025.
Petitioners shall remain present in person on the NDOH.
