An application u/O 6 Rule 17 CPC filed by Ld.
Counsel for plaintiff seeking amendment of plaint and another
application for placing on record the certificate u/s 63 of Bhartiya
Sakshaya Adhiniyam, 2023.
Submissions heard. Record perused.
Based on the contents of the application seeking
amendment and considering that the amendment is necessary for
just decision of the case and that the summons are yet to be
issued to the defendant, the present application is allowed.
Amended plaint is taken on record.
Now another application for placing on record the
Certificate u/s 63 of Bhartiya Sakshaya Adhiniyam, 2023 is
taken up for consideration.

Based on the contents of the application and that the
same is a formal document and the summons are yet to be issued
to the defendant, the present application is allowed and the
Certificate u/s 63 of Bhartiya Sakshaya Adhiniyam, 2023 is taken
on record.
Both the applications are disposed off accordingly.
Issue summons of the suit to the defendant for
settlement of issues, through all permissible modes, on filing of
PF/RC including electronic mode, subject to filing of affidavit
mentioning whatsapp number and email id and copy of plaint and
annexing document in PDF format. If the defendant refuses to
accept the service or is not found, then process server is directed
to do affixation as per Order V Rule 17 CPC. Ahlmad is
directed to make the endorsement on the summons regarding
affixation as per Order V Rule 17 CPC.
