File taken up today on an application moved by DH seeking early
hearing.
Note: All Counsels appearing through VC are requested to ensure that
their video is on when their matter is taken up. Their appearance will not
be noted otherwise. They are also requested to appear in proper court attire
from an appropriate place having no background noise.
Present: Mr. B.S. Chauhan, Ld. Counsel for DH along with DH
in person.
JDs namely Fazia Parveen and Iqbal Jahan in person.
It is stated by counsel for DH that vide order dated
20.04.2026, the appeal against the impugned decree has been dismissed
with cost of Rs.20,000/-. That, with the dismissal of the appeal, the stay
has been vacated and therefore, appropriate orders may be passed for
execution of the decree.
Submissions heard. Record perused.
Since the appeal stands dismissed and there is no stay in
operation, let warrants of possession be issued against JDs, on filing PF/RC
returnable for NDOH.
DH to appear before Ld. ACJ for appoint of Bailiff on
25.05.2026.
Bailiff is at liberty to break open the locks in case of
refusal / premises found locked. The SHO concerned is also directed to
provide necessary police aid to the DH, if required.
