Present: Sh. Mithlesh Jha, Ld. counsel for plaintiff alongwith
the plaintiff.
Sh. Rohit Kumar Sharma, Ld. counsel for
defendants alongwith defendants.
Fresh Vakalatnama has been filed on behalf of the
defendants. Same is taken on record.
Matter received back as settled from mediation
center.
Ld. counsel for plaintiff states that as per the
mediation settlement, the defendants were supposed to make the
payment by 05.12.2024, however, the same has not been made.
Ld. counsel for defendants states that payment shall be made
within 1.5 months.
Ld. counsel for plaintiff upon instructions states that
one such last opportunity be given to the defendants failing
which the matter be proceeded on merits.
Ld. counsel for plaintiff prays that ad-interim
injunction be granted till the next date and the defendants be
directed to not dispossess the plaintiff from the suit property.
Ld. counsel for defendants upon instructions states
that without prejudice to the rights and contentions on the merits
of the case and without admitting the case of the plaintiff, the
defendants shall not dispossess the plaintiff from the suit
property till the NDOH.

Accordingly, defendants are directed to not
dispossess the plaintiff from the suit property till the next date
and contentions of the defendants on the merits of the case are
reserved.
Now to come up for confirmation of payment/
further proceedings on 27.01.2025.
