Perusal of record shows that present suit has been filed
for recovery of amount and is still pending for proper service upon the
defendant since institution of present suit i.e. 05.06.2023.
Further record shows that several opportunities were
granted to plaintiff to pursue the present case, however, the same has
not been done on behalf of the plaintiff. Moreover, on 18.09.2025 and
19.01.2026, defendant was directed to be served by way of
publication in newspaper, however, steps not taken on behalf of the
plaintiff.
In view the above observation, considering the conduct
of the plaintiff, it appears that the plaintiff is not interested in pursuing
the present suit, accordingly, the suit of plaintiff is dismissed and
disposed off for non prosecution.
