Present: Ms. Shweta Garg, Ld. counsel for plaintiff through
VC.
Sh. Chirag Sharma, Ld. counsel for defendant
through VC.
Vide last order, defendant was directed to file WS within
30 days from that date.
Ld. counsel for defendant submits that in terms of the
last order, soft copy was supplied by the Ld. counsel for the plaintiff
to the defendant. Due to some personal difficulty, he could not get the
same from the defendant and therefore, WS has not been filed till date.
On court query, Ld. counsel for defendant submits that
vakalatnama or any memo of appearance has not been filed by him on
behalf of the defendant. No person can appear on behalf of the other
without any vakalatnama executed in his favour and duly filed in the
case. Therefore, Ld. counsel for defendant could not appear before this
court on behalf of the defendant.
The 30 days time to file the WS has already expired on
27.09.2025. In view of the same, right to file the WS by the defendant
is hereby closed.
In the interest of justice, one last and final opportunity is
granted to the defendant to appear and pursue the case otherwise, he
may be proceeded ex-parte.
Put up for appearance of the defendant on 20.12.2025.
