Deepak Garg, Ld. counsel for plaintiff Ms. Anshika, Ld. proxy counsel for defendant/ MCD. Matter is at the stage of PE. Ld. counsel for plaintiff submits that plaintiff has suffered a paralysis attack recently and she is not in a position to depose today. Ld. counsel for the plaintiff further submits that the SPA holder of the plaintiff is her son only and by mistake the earlier evidence affidavit was filed on behalf of son namely Rakesh Kumar of the plaintiff as a SPA holder of the plaintiff and not in his independent capacity as a witness of facts. Therefore, Ld. counsel for plaintiff submitted that since plaintiff is not in a position to depose before this court, therefore, he will move appropriate application for filing of fresh evidence affidavit of son namely Rakesh Kumar of the plaintiff as witness in the present case along with appropriate documents showing the illness of the plaintiff. Plaintiff is at liberty to move appropriate application on or before the NDOH with advance copy of the same to the opposite party. Renotify for PE on 16.02.2026.
