Necessary affidavit of SPA holder of the plaintiff and
NOC-cum-affidavits of other LRs of missing person, have been filed
in terms of last order. Same are taken on record. Copy supplied.
Matter is pending for remaining PE.
It transpires that on the LDOH, official from concerned
PS was summoned for today to bring the record regarding complaint
vide DD No.20A dated 30.08.2013. At this stage, one person namely
Sh. Sunil, Delhi Home Guard from PS Samaypur Badli has appeared
and he has filed the report under the signature of HC Kapil Nain duly
forwarded by SHO concerned, as per which, the necessary record has
already been destroyed. Alongwith the report, copy of the necessary
order dated 22.04.2021 and 28.10.2024 have also been attached.
Ld. counsel for plaintiff was apprised with the said
report, whereupon Ld. counsel for the plaintiff submitted that in view
of this report, plaintiff does not wish to examine any other witness and
requested that PE may be closed. Accordingly, PE stands closed.
Ld. counsel for defendant submitted that the defendant
does not wish to examine any witness in DE and requested that DE
may be closed.
In view of the submissions made, DE also stands
closed.
