No written statement has been filed till date on behalf of
defendant No.2 despite directions to file the same within 30 days.
Further, it is submitted on behalf of plaintiff that no other
document pertaining to the loan in question could be traced. Heard.
Perusal of the record shows that the only documents annexed
with the plaint are legal notice, authority letter in favour of AR of plaintiff bank
and one document dated 20.09.2021 title “Transfer of Salary Account of Mrs.
Krishna W/o Sh. Suresh having loan account with Central Bank of India, Chuna
Mandi”.
In the given circumstances, the Court is of the opinion that
without any other document qua the loan in question, the present suit cannot
be allowed to proceed further. Accordingly, the main counsel for plaintiff and
appropriate official (not below the rank of Manager) of the plaintiff bank who is
apprised of the facts of the present case, are directed to appear on the next
date of hearing.
