At this stage, an application seeking substitution of AR, an
application under Order V Rule 20 of CPC along with an application seeking
waiver of cost and certificate under Section 63 of Bharatiya Sakshya Adhiniyam,
2023 have been filed on behalf of plaintiff.
AR of plaintiff is directed to appear in person.

Application for substitution of AR moved on behalf of plaintiff is
taken up.
Submissions heard. Perused.
Application is supported by photocopy of Board Resolution in
favour of proposed AR. Since the application is formal in nature, therefore,
allowed and Sh. Jibachh Kumar Jha is taken as new AR of the plaintiff bank in
place of earlier AR. Application disposed off accordingly.
Perusal of order dated 29.07.2024 reveals that plaintiff was
directed to apprise the court as to how he wish to proceed with the present case
in the absence of documents of loan in question.
One final opportunity is given to the plaintiff to clarify this aspect,
failing which appropriate orders shall be passed.

AR of the plaintiff along with main counsel is directed to present
on the next date of hearing as well.
Remaining applications shall be taken up on the next date of
hearing.
