Present: Sh. Ram Raghvender Kumar, Ld. counsel for the plaintiff.
Ms. Anushree Mahindra, Ld. proxy counsel for proposed
counsel for defendant no.2/MCD (through VC).
It is submitted on behalf of the plaintiff that since he did not
have the contact details of defendant no.2, salary slip, employee ID of
defendant no.1 could not be supplied to him but he has sent the same to the
Commissioner of MCD.
It is submitted on behalf of defendant no.2 that due to non
supply of the said documents, details of defendant no.2 could not be traced,
hence, written statement could not be filed.
Perusal of the record shows that Ld. proposed counsel has
been appearing on behalf of defendant no.2 since the past two dates of
hearing but till date, no vakalatnama has been filed on their behalf despite due
undertaking. In the given circumstances, a cost of Rs. 500/ is imposed upon
defendant no.2 to be deposited in Armed Forces Battle Casualties Welfare
Fund. Let cost receipt be filed on next date of hearing.
Defendant no.2 is directed to file vakalatnama within two days
from today and contact the ld. counsel for the plaintiff thereafter to obtain the
salary slip/employee ID card of defendant no.1. Let written statement be filed
within 30 days from the said date.
