Matter is listed for arguments on the application seeking leave to defend.
A request for adjournment is again made today on behalf of petitioner for
filing a reply to the application on the ground of ill health of the petitioners.
Record speaks volumes about the negligent conduct of the petitioners as
costs were imposed upon the petitioners on three different occasions vide order dated
21.12.2024, 12.03.2025 and 08.07.2025.
Ld. Counsel for petitioners submits that he has deposited the cost imposed
vide order dated 12.03.2025. However, there is no such receipt on record.
Furthermore, admittedly, cost imposed upon the petitioners vide order dated
21.12.2024 and 08.07.2025 has not been paid. Let it be paid during the course of the day
to other side against receiving.
The application seeking leave to defend was filed on 22.03.2025 and since
then, petitioners have not bothered to file a response despite passing of about 9.5
months. This itself shows that petitioners are not serious in pursuing the present petition.
However, in the interest of justice and subject to further cost of Rs.10,000/- to be
deposited by the petitioners in the A/c of District & Sessions Courts Employees
Welfare Association Delhi (SBI Account No. 38222714058 / IFSC : SBIN0000726 /

Branch: Tis Hazari), petitioners are granted one last opportunity subject to the
aforesaid compliance, to file reply within two weeks from today with advance copy
to the opposite side. Receipt of the same be filed before NDOH.
It is clarified that if no reply is filed, application shall be decided on
merits on the NDOH.
Be adjourned for arguments and disposal of the application seeking leave to
defend for 27.03.2026.
