None for the accused (proprietor).
BWs issued against the accused received back executed. However,
accused has failed to appear.
Complainant’s side submits that despite efforts of settlement, accused
has paid Rs.65,000/- till date.
Today, accused has failed to appear.
It appears that accused is deliberately avoiding the appearance before
this court and concealing himself. Hence, let NBWs be issued against the accused
through the concerned SHO on filing of PF within two months, returnable on
NDOH.
Warrant should carry an endorsement that accused is at liberty to settle
the matter and pay the amount to the complainant by reaching out the complainant
on the no. 9136582045, in view of the judgment passed by Hon’ble Supreme Court
of India, in case titled as
Sanjabij Tari Vs. Kishore S. Borcar & Anr., 2025 (SC)
.
Warrants should also mention that if accused has failed to pay the
entire amount, matter shall be proceeded on merits.
Complainant is directed to supply the soft copy of complaint and
documents to the accused well in time.
Put up for appearance of accused/ framing of notice/ furnishing of
surety/ further proceedings on 18.03.2027.
