Present : Sh.Sumit, Ld. Proxy Counsel for the complainant.
BWs issued against no.2 vide previous order received back
unexecuted with report that accused no.2 has left the given address and
the accused company has been closed.
The perusal of record shows that Ld. Counsel for the
accused had put an appearance vide order dated 15.04.2025 and sought
adjournment for appearance of accused.
The Aadhar proof accused no.2 annexed with the court
record mentions address 47, Sector-3, Fatehabad, Haryana and the
address of the accused company is already on record mentions the same
office address. Therefore, the report received on BWs cannot be relied
upon.
Therefore, court is of the opinion that the accused is well
aware about the present proceedings and deliberately absconding from
the clutches of law.
In view of the aforesaid submissions, issue NBWs against
the accused no. 2 at the given address and at 47, Sector-3, Fatehabad,
Haryana, through SHO concerned, on filing of PF, returnable on NDOH.
SHO concerned is directed to ensure that the multiple visits
have been made for execution of warrants and statement of independent
witnesses is recorded at the time of execution of warrants alongwith copy
of their ID proof.
Re-list the matter for 22.01.2026.
