The defendant has given previous cost of Rs. 10,000 to the Ld.
Proxy Counsel for the plaintiff. Receiving is taken on record. The main
counsel for the plaintiff appeared through VC and authorized Ld. Proxy
Counsel to receive the said cost.
2. WS has already been filed on record. Replication has been filed
today. Copy supplied.
3. Put up for filing of affidavit of admission/denial of documents
and framing of issues on 14.01.2026. Ld. Counsels for parties are apprised
about the process of appointment of Local Commissioner for recording of
evidence for expeditious disposal of the case. The fees of the Local
Commissioner shall be fixed @ 2500 per hour which will be paid by plaintiff
for plaintiff’s witnesses (for examination in chief as well as cross-
examination) and by defendant for defendant’s witnesses (for examination in
chief as well as cross-examination). Both the parties are directed to discuss
and confirm it on the next date.
