Mr. Advait Arora, Ld. Counsel for JD.
Notice has been duly served on JD. Despite service, JD
has not filed calculation/objection.
The report of the Civil Nazir is on record. Perused the
same.
Ld. Counsel for the DH submits that the present
execution petition has been filed in relation to the amount qua which
the order dated 07.07.2026 was passed wherein no interest had been
granted.
It is stated that despite the aforesaid order, no payment
has been received by the DH from the JD and there is no stay in the
present matter. It is prayed that warrants of attachment qua the bank
account of the JD bearing account no. 41010068213 may be issued.
Heard.
In view of the submissions made, let warrants of
attachment qua the amount of Rs. 6,57,878/- qua the bank account no.
41010068213, State Bank of India, Chandni Chowk of the JD be
issued on filing of PF and affidavit of the DH regarding there being no
stay in the matter. Steps to be taken within 3 days from today.
JD is at liberty to file objections /calculation on or
before the next date of hearing which shall be duly considered before
handing over the cheque to DH.
