period of limitation.
6. In the agreement to sell, the period of 03 months was also
mentioned for payment of remaining amount and execution of documents
and if the same is counted as well as taking into account the benefit of
exclusion of period as granted by the Hon’ble Supreme Court of India,
the suit is within the period of limitation. Accordingly, this court is of the
opinion that the plaintiff has a good
prima facie case in his favour.
7. Now, it is stated that the plaintiff is in possession of the suit
property. The Counsel for the defendant states that the plaintiff is residing
in the suit property as a tenant of the defendant.
8. Accordingly, both the parties are restrained to create any 3rd
party interest in the said property by way of transfer, sale, gift deed,
further lease or any other recognized mode of transfer of property without
permission of this court till the disposal of the case. The stay application
is disposed off.
9. Affidavit towards admission/denial of documents filed on
behalf of the defendant. Copy supplied.
10. Put up for filing admission/denial of documents on behalf of
the plaintiff and framing of issues on 11.11.2024. Copy of order be given
dast, if desired.
