File is taken up today at the application of the Decree Holder for
early hearing and disposal of the case.
Present: Sh. Arnab Kumar Mondal, Ld. counsel for DH.
Perusal of the record shows that an application
seeking early hearing and disposal of the case was filed on
05.01.2024 on behalf of the DH which was posted for hearing
on 09.01.2024. Since on 09.01.2024, the undersigned was on
leave, matter was adjourned for today i.e. 11.01.2024.
It is submitted by ld. counsel for the decree holder that
the cheque bearing no. 348826 dated 22.12.2023 drawn by SBI,
Chandni Chowk Branch, Delhi in the sum of Rs.3,35,769/-,
which has been received pursuant to warrant of attachment directed
to be issued vide order dated 03.11.2023, satisfies the decree.
At this stage, the report of the Nazir is perused.
According to which cheque no.348826 dated 22.12.2023 drawn by
SBI, Chandni Chowk Branch, Delhi in the sum of Rs.3,35,769/-,
has been received on 03.01.2024 which is on record.
Ld. counsel for the DH further requests for allowing
him to withdraw the present execution petition as satisfied. He
further prays that the cheque be released to him and the execution
petition may be disposed of as satisfied.
Let statement of the ld. counsel for the DH recorded
separately in this regard.
In view of the submissions and statement of Ld.
counsel for decree holder, the execution petition is disposed of as
satisfied. Cheque be released to the Ld. counsel for decree holder as
per rules.

The date already fixed i.e. 09.02.2024 stands cancelled.
It is reported that notice to the JD/MCD in terms of order dated
15.12.2023 could not be issued inadvertently. However, in view of
the fact that the decree stands satisfied in the present case the
direction for issuing notice for JD on 15.12.2023 are hereby recalled
and stands cancelled.
File be consigned to the record room.
