This is the suit for the relicf of permanent injunction restraining
<br>
the Defendants from infringment of Trademark and Copyright, passing off,
<br>
acts of unfair compctition, dilution, rcndition of accounts etc filed by plaintiff
<br>
against the Defendants which is accompanicd by applications which are as
<br>
follows :
<br>
1) under Order 39 Rule I and 2 CPC sccking interim reliefrinjunction
<br>
2) under section 151 CPC sccking cxcmption from filing original
<br>
documents/clear and legible copies,
<br>
3) under Section 12 A of The CC Act sccking cxemption from instituting
<br>
pre-litigation mediation,

Counscl for Plaintiff sceks exemption from Pre-Institution
<br>
Mediation, as rcquired under Section 12A of The Commercial Courts Act,
<br>
2015 (n short 'the Act), in vicw of the urgency explained.
<br>
Considering the exigent circumstances as also explained by ld.
<br>
Counsel for Plaintif, the application secking exemption stands allowed.
<br>
Issuc summons of suit (in the prescribed form viz., the summons
<br>
for settlement of issucs) as well as of the accompanying applications with all
<br>
the annexed documents upon defendant through all modes & through e-mail
<br>
and Whatsapp as wcll on filing of PF/RC-AD/ speed post/ courier, returnable
<br>
for NDOH.
<br>
In terms of Rule 13, Plaintiff is directed to place on record a copy
<br>
of the plaint and documents in electronic format/ scanned images in
<br>
compliance of Rulc 13 for forwarding/annexing/ attaching the same with the
<br>
process.
<br>
Requisite process fee for sending process by electronic mode in
<br>
compliance of Rule 14 be also filed along with the copies as above for onward
<br>
transmission to Nazarat Branch, Tis IHazari Courts.
