An application U/O 11 Rule 1 (10) r/w Section 151 CPC
moved on behalf of defendant for seeking leave to file the
additional documents is pending disposal.
Arguments heard from both the sides.
It is stated that the defendants were served with show
cause notice dated 27.05.24 from Commercial Taxes Department
and that show cause notice is required to be placed on record.
Further the State Tax Office Secunderabad Division,
Hyderabad passed a detailed order dated 02.08.24 directing the
defendants to pay the outstanding amount and this order is also
required to be placed on record.
It is stated that the documents are very relevant to decide
the controversy in question.
Application is opposed by Ld. counsel for the plaintiff.
However, after hearing both the sides, the court is of the
opinion that the documents are relevant for deciding the
controversy in question. Althouth these documents could have
been filed earlier by the defendant and for delay in moving the
application, cost of Rs. 5,000/- is imposed upon the defendant to
be paid to the other side. Let cost be paid within a week.
Subject to payment of cost, thte application is allowed. The
application stands disposed off accordingly.

It is stated that on behalf of defenedant affdiavit of Sh.
Vikram Singh Bhadoria witness of the defendant has already
been filed which is on record.
DW1 Sh. Vikram Singh Bhadoria partly examined and his
cross-examination is deferred at the request Ld. counsel for the
plaintiff.
Put up for cross-examination of DW1 on 07.05.25.
