Counsel for the defendant moved an application seeking exemption from physical appearance of witness namely Damneesh Yadav for today stating that he is out of station due to some urgency. Adjournment is opposed by counsel for the plaintiff stating that earlier the present matter was listed for DE. Subsequently, defendant moved an application under Order XVI Rule 5 CPC for framing of additional issues which was disposed of. Defendant was given opportunity to lead evidence but again adjournment is being sought. It is prayed by counsel for the plaintiff that keeping in mind the conduct of the defendant, cost be imposed upon the defendant. Heard. In view of the above facts and circumstances, particularly even the affidavit of evidence of witness has neither been filed on record nor copy of the same supplied to the plaintiff so far, therefore, a cost of Rs. 2,000/- is imposed upon the defendant to be paid to the plaintiff on the next date of hearing.
