Although written statement is stated to be filed in
soft form, hard copy has not been placed on record.
Learned counsel for the defendant undertakes to
place the hard copy of the written statement on record within a
week from today.
An application for condonation of delay of 11 days
in filing the written statement is stated to have been filed
alongwith the written statement.
There is no serious objection to the said application.
The application is, accordingly, disposed off as allowed. Written
statement is taken on record.
Learned counsel for the plaintiff objects to the filing
of the Statement of Truth and affidavit of admission-denial while
contenting that the same are not in line with the requirements of
the Commercial Courts Act.
Defendant side is directed to place on record the

proper affidavit of admission-denial and Statement of Truth
within two weeks from today with advance copy to the learned
counsel for the plaintiff.
An application under Order VII Rule 10 CPC is also
stated to have been filed.
Learned counsel for the plaintiff submits that he
would file reply to the said application within two weeks from
today with advance copy to the learned counsel for the defendant.
Replication, if any, be filed within the time
prescribed after the service of fresh affidavit of admission-denial
and Statement of Truth on the plaintiff side.
Matter to now come up on 23.12.2024 for
completion of pleadings, consideration on pending applications,
admission-denial, framing of issues and Case Management
Hearing.
