Present: Ld. Counsel Mr. Sumit Sourabh for the plaintiff.
Steps not taken for the service of defendant.
Counsel for the plaintiff has filed an application u/o 6
rule 17 CPC for amendment in para 4 and 5 of the plaint for
difference in the rate of interest in GECL and GECL (Extn) 2.0. It is
submitted that the suit is at initial stages and no prejudice will be
caused, if the application is allowed.
Heard and perused the application. The suit is at its
initial stages and summons have not been issued to the defendant.
No prejudice will be caused to the defendant, if the proposed
amendments are allowed. Accordingly the application is allowed
and is disposed of. Amended plaint is taken on record.
An application has been filed for substitution of AR of
the plaintiff on the ground that the present AR has been transferred
and the plaintiff wants to substitute Mr. Rahul as AR in place of Ms.
Charu Dubey. Application is accompanied by the GPA in favour of
AR.
Heard the application and the application is allowed.
Sh. Rahul son of Sh.Bhoja Ram Yadav is substituted as AR of the
plaintiff in place of Ms. Charu Dubey. Application stands disposed
of accordingly.
Plaintiff shall take steps for service of defendant within
a week from today. Summons for appearance in Form no.4

Appendix B be issued to the defendant through all possible modes
i.e. PF/RC, speed post and through electronic modes i.e. whatsapp
and through e-mail.
