Mr. Ashu, Ld. Proxy Counsel for the defendant
(through Video Conferencing).
According to process server’s report, the defendant
was served with the summons of the suit, through
post on 14.06.2024. He was also served with the
summons of the suit, through whatsapp on his
mobile Nos. 9928013651 and 9414167375 on
29.05.2024. According to report, complete paper
book of the plaint (comprising 37 pages) having 4.7
MB size in pdf form was delivered to the defendant.
Ld. Counsel for the defendant stated that he
received only 7 pages. Much water has flown and
the Court will not take cognizance of such lame
excuses. The limitation period for filing of written
statement already lapsed on 01.07.2024. Ld.
Counsel for the plaintiff is seeking adjournment of
the case for the month of September, 2024. In that
case, the plaintiff will not be entitled to interest for
the intervening period, in case the plaintiff succeeds
in the case. To come up for PE on 04.09.2024.
