This suit seeking recovery of Rs.12,28,998/- with interest @12% per
annum is said to have been settled between the parties out of Court for Rs.9.50
lakhs which is undertaken to be paid by January 2025.
An application under Order 23 Rule 3 CPC is e-filed supported with
affidavit on behalf of plaintiff. Defendant has also e-filed the affidavit. Settlement
deed has already been placed on record.
In the light of the relevant respective affidavits, no separate
statements are being recorded. Parties are bound by the terms of the settlement.
Terms of settlement shall form part of the decree.
Decree sheet be prepared accordingly.
Court fees be refunded as per rules.
File be consigned to Record Room after due compliance.
