Perusal of file shows that on 21.08.2026, the DH has filed an
application under section 151 CPC for preponement of the date of hearing.
However, on 21.08.2026, the above application was fixed for today i.e.
08.09.2026, the date already fixed.
On 21.08.2026 alongwith above application the DH has filed an
order dated 18.08.2026 passed by Hon’ble High Court of Delhi in RFA (COMM)
554/2024, wherein Hon’ble High Court has directed to the executing court to
accept the immovable property owned by the wife of Respondent No.2 (DH No.2
herein) as security, subject to verification of the title and encumbrance status of
the said property and production of the original sale deed.
Ld. Counsel for the DH seeks one opportunity to file original sale
deed alongwith the encumbrance status of the said property.
The above application for preponement of the matter bearing I.A
No. 02/2026 is disposed of accordingly.
Put up on 14.09.2026 for consideration.
