ORDER
The plaintiff is the trust and suit came to be filed
through its trustees. On 27th September, 2023 the trustees have
passed the resolution that, on 23rd June, 2023 they have authorized
Mrs. Kashmira Mehernosh Kapadia and/or Mr. Viraf Phiroz Bharucha
to act jointly and severally to represent the plaintiff trust in the Court
matter, sign any letter and application. By way of that resolution, Mr.
Viraf Bharucha had filed the Consent Terms (Exh. 33) on behalf of
the plaintiff. The Consent Terms (Exh. 33) bear the signatures of
authorized person of plaintiff trustee Mr. Viraf Bharucha, defendant
and their Ld. Advocates. The Consent Terms (Exh. 33) is read over
and explained to them. This Court is satisfied with the terms of
