ORAL ORDER :
1. The plaintiff has filed an application for grant of
permission to deposit the arrears of rent amounting to Rs.19,200/-
from August 2025 to July 2026 @ Rs.1600/- per month, further rent
@ Rs.1600/- per month from August 2026.
2. It is contended by the plaintiff that he has paid the rent
@ Rs.1600/- per month continued upto June 2025. The defendant
not issued the rent receipt with ulterior motive.
3. Per Contra, inspite of giving sufficient opportunity, the
defendant failed to file say.
4. Perused the application and heard Ld. Advocate for the
plaintiff. The rent receipt dated 2/9/2025 discloses that monthly
rent of Rs.1600/- per month and rent paid by way of cheque
No.000031 dated 2/9/2025, Bank of Baroda, towards arrears of rent

for 123 months from 1/5/2015 to July 2025 @ Rs.1600/- per month
inclusive of taxes.
5. Now the plaintiff intends to deposit the rent from August
2025 till July 2026 and subsequently till disposal of the suit.
Therefore, without prejudice to the rights of the defendant, the
plaintiff is permitted to deposit the arrears of rent and further rent
till disposal of the suit.
ORDER
1. Application is allowed.
2. The plaintiff is directed to deposit the arrears
of rent of Rs.19,200/- for the period from
August 2025 to July 2026.
3. The plaintiff is further directed to deposit the
arrears of rent from August 2026 till
September 2026 @ Rs.1600/- per month.
4. The plaintiff is further directed to pay the rent
from October 2026 till the decision of the suit
@ Rs.1600/- per month, on or before 10th day
of each month.
