Perused the record and Roznama. The matter is fixed for
dismissal order on today. The plaintiff as well as his learned advocate
remained absent when repeatedly called 3.30 p.m. It also appears that
previously also the suit was fixed for dismissal order by passing order
below Exh. 1 on 10/01/2023. The caption was removed by passing
order below Exh. 16. Moreover the amendment application Exh. 17 has
been already rejected on 08/11/2023. Since then the plaintiff failed to
produce evidence. Therefore, it appears that the plaintiff is not really
interested in the prosecution of the present suit. Therefore, it will be
fruitless to keep the matter pending as it is. It will also cause
unnecessary harassment to the defendant. Hence, it is a fit case to
dismiss the suit. Accordingly, following order.
