ORAL ORDER :-
This is an application filed by plaintiff for granting
permission to file rejoinder to Exh.24.
2. Advocate for defendants strongly objected the present
application by giving handwritten say on overleaf of the application.
3. Perused application, say thereon and record. Heard both
sides. On perusal of record, it appears that application Exh.24 filed by
plaintiff on 10.12.2025 for amendment. On 21.01.2026 the defendant
has filed reply vide Exh.25. Plaintiff wants to file rejoinder to the reply
filed by defendant. Advocates for the parties have not yet started
therein arguments over said applications. Therefore, no prejudice would
be caused to the defendant, if the application is allowed. It is necessary

to give fair opportunity to the parties to put up their case.
Considering the same and the fact that the plaintiff has annexed the
rejoinder along with present application, therefore, in my view it is
necessary to allow the plaintiff to file rejoinder on record. The
defendant is also having a right to file sur-rejoinder. Apart from this,
the controversy between the parties will be decided on merits.
Accordingly, I proceed to pass following order:-
: O R D E R :
1. Application is allowed.
2. Rejoinder of plaintiff to his application at
Exh.24 be taken on record.
3. No order as to costs.
