ORAL ORDER :-
1. This is an application filed by Ld. Advocate for the
defendant for permitting the defendant to deposit arrears of rent in
the Court, as per order passed below Exhibit No.15 dated 02.07.2025
by condoning the delay.
2. Perused the application and handwritten say given by
the Learned Advocate for the plaintiff on overleaf of present
application. Heard both the sides.
3. From the perusal of record, it reveals that, this Court
vide order passed below Exhibit No.15 dated 02.07.2025 has directed
the defendant to deposit the arrears of rent from January 2001 and

continued to deposit the rent on or before 10th day of every month.
However, it appears from the application that the defendant has not
deposited rent accordingly. The defendant has stated the reason for
not depositing the rent that due to financial problem, he could not
deposit the rent. The defendant is ready to deposit the amount of
rent as per the order of this Court. Hence, taking into account the
reason assigned by the defendant, it is just and proper to permit the
defendant to deposit the arrears of rent without prejudice to the
rights and contentions of both the parties. No prejudice would be
caused to the plaintiff, if this application is allowed. Therefore, the
application deserves to be allowed. Hence, I proceed to pass the
following order:-
: ORDER :
1. Application Exhibit No.21 is allowed.
2. The defendant is permitted to deposit in the
Court the arrears of rent from January 2001 to
July 2025 as per order passed below Exhibit
No.15 dated 02.07.2025 on or before next
date.
3. The defendant is further directed to continue
to deposit in the Court the future rent from
August 2025 onwards as per order passed
below Exhibit No.15, dated 02.07.2025.
4. This order is passed without prejudice to the
rights and contentions of both the parties.
