ORDER :
The defendant nos. 1 to 8 have filed present application
stating that the summons is duly served to them on 10/09/2024.
The written statement is to be approved by the society committee
members. Hence, due to said delay in approval there is delay of six
days in filing written statement. Hence, prayed to condone the
delay in filing written statement.
2. The say filed by the plaintiff on same application stating
that there is no ground made out to condone the delay. Hence,
prayed to reject the application.
3. Heard advocate for both parties at length.
4. On perusal of record, it appears that the suit summons is
duly served to the defendants on 10/09/2024. It means, the
application should be filed till 10/12/2024. But, the present

application is filed on 15/10/2024. It means, there is five days
delay in filing written statement. The reason mentioned in the
application appears to be true one. The suit is for declaration of the
tenancy right in respect of the suit premises. The important rights
is to be decided between both parties. Hence, in the interest of
justice it is necessary to allow the application. Hence, I pass the
following order:
ORDER
1. The application below Exh. 21 is allowed.
2. The written statement of the defendant nos. 1
to 8 is taken on record.
3. Both parties to take note.
