ORDER :
The defendant has filed present application stating that
the plaintiff has filed affidavit of evidence in the matter. But, the
paging and serial numbers to the documents are not proper.
Moreover, the plaintiff has not filed the documents in proper form.
Hence, the defendant prayed that plaintiff may be directed to file
fresh list of documents with proper paging.
2. The say filed by the plaintiff on the same application
stating that it is delay tactics played by the defendant. The
defendant is delaying the matter. The copies are already served to
the defendant long back. Hence, prayed to reject the application.
3. Heard advocate for both parties at length.
4. I perused the documents served to the defendant and also

compared with the documents filed on the record of the Court.
There is only mis-paging of the documents and plaintiff has not
submitted one document which is mentioned at the last serial
number of the list of documents. The advocate for the plaintiff has
given another copy of the list to the advocate for defendant before
the Court. The advocate for defendant has directed to check the
said list in front of the Court. Hence, I pass the following order:
ORDER
1. The application below Exh. 23 is allowed.
2. The advocate for plaintiff is directed to correct
the paging and submit document today itself.
The advocate for defendant checked the
documents before the Court today itself.
3. Both parties to take note.
