Oral Order :
Perused the application and heard learned advocate for the
defendant No. 3. It appears that the defendant No. 3 was impleaded as
a party defendant on his application. The defendant No. 3 neither filed
written statement nor filed counter-claim. In such circumstances, the
application is filed to withdraw the claim of the defendant No. 3
unconditionally. As there is no claim filed on behalf of the defendant,
there is no question of withdrawing the same. The learned advocate for
the defendant No. 3 failed to point out any provision of the law to
substantiate the present application. Hence, the application is devoid of
merits and deserves to be rejected. Accordingly, following order.
