2) 1. I say that the Plaintiff has filed the Execution
Application. I say that by the Hon’ble Court was pleased to
pass no reply order on the Execution Application. I say that
the Defendant has filed an application at Exhibit 11 for
setting aside the said No reply Order before the Hon’ble
Court. I crave leave to refer to and rely upon the papers and
proceedings of the above matter as and when required.
2. I say that as I was not available due to my personal
difficulty, the reply to the execution application couldn’t be
affirmed and therefore same was not annexed along with the
Application at Exhibit 11. I say that therefore the Defendant
is seeking permission to file his rejoinder to Exhibit 11
inorder to deal with the allegations of the Plaintiff in its reply
at Exhibit 12 along with Affirmed Affidavit in reply to the
execution application.
3. I say that therefore the Defendant humbly prays that
the Defendant be permitted to file his rejoinder on
