application is not maintainable in the eye of law. The exparte order
is already passed on 29/11/2023. There is no any negotiations for

mentioned in Exh. A. The plaintiffs have never put their own lock
over the suit premises. Hence, prayed to reject the application.

4. On perusal of record, it appears that the defendants are
duly served on 29/08/2023. Then the defendant appeared through
VP on 05/09/2023. Then the Court has passed ‘No written
statement’ order on 29/11/2023. It means, the written statement
should be filed till 29/09/2023. But, the present application is
filed on 03/01/2024. There is near about three months delay. I
perused email which is filed along-with application. Hence, it
appears that the settlement talks were going on between both
parties. The suit is for recovery of possession of the suit premises.
