for the plaintiff stated the reason in this application that the
defendant was not present before this Court, therefore, the costs
order could not be complied with. Considering the reasons
mentioned in the application and in order to avoid multiplicity of the
proceeding, in the interest of justice, it is just and proper to give an
opportunity to the plaintiff to pay the cost as per order passed below
applications Exhibit Nos.14 and 15 dated 23.06.2025. The plaintiff
prayed for permitting him to deposit the said costs in the Court.
However, today C.A. of the defendant is present. Considering the
same, it is proper to direct the plaintiff to pay said costs directly to
C.A. of the defendant rather permitting him to deposit the same in
the Court. It will save the time. Also no prejudice will be caused to
either party, if the said costs is directly to be paid to C.A. of the
defendant. Hence, I proceed to pass the following order:-
ORDER
1. Application Exhibit No.19 is allowed.
2. The plaintiff shall pay the said costs directly
to C.A. of the defendant and C.A. of the
defendant to accept the costs in compliance
of order dated 23.06.2025 passed below
Exhibit applications Nos.14 and 15
respectively.
3. No order as to costs.
