1. This is an application filed by Ld. Advocate for the
plaintiff for removing the matter from order caption.
2. Perused the application and handwritten say given by
Ld. Advocate for the defendant on overleaf of the application. Heard
both sides.
3. Perusal of record it reveals that the matter was kept for
filing evidence by plaintiff. As the plaintiff failed to file evidence, the
matter was kept for further order vide Roznama dated 01.02.2025. It

appears from record that this suit is filed for declaration of tenancy.
Along with this application, the plaintiff has filed affidavit of
examination in chief. Therefore, considering the nature of suit and
reason mentioned in the application, it is necessary to give an
opportunity to the plaintiff to lead evidence. Thus, in order to decide
the matter on merits, it is just and proper to remove the matter from
the order caption. Hence, I proceed to pass the following order:-
