ORAL ORDER :
Read application and say thereon. Heard both sides.
Perused record. Perusal of record shows that previously also no cross-
examination order was passed against defendants and it was set-
aside. Despite that and even after giving sufficient opportunity, as the
defendants failed to cross examine PW1, as a last resort, the
impugned order came to be passed. However, as the matter is still
pending, in order to have the adjudication of the matter on merits, it
would be just and proper to give one more opportunity to the
defendants to conduct the cross-examination of the PW1, by
imposing certain costs. Considering all these aspects, application is
allowed subject to costs of Rs. 2000/-. The defendants are permitted
to cross examine the PW1 after compliance of costs condition and
with further direction to complete the cross-examination on next
date itself, failing which no further opportunity shall be given under
any circumstances.
