ORAL ORDER :
1. Today matter appeared for argument on Exh.21
application filed for striking off written statement for failure to
deposit interim compensation amount. Admittedly, defendant has
challenged the order before the Hon'ble High Court. Defendant
further has also deposited part amount of Rupees Three Lacs. Today,
Ld. Advocate for plaintiff has also submitted that there are talks
going on between plaintiff and defendant, but he apprehends that
they would not be fruitful. Hence, he pray that the application be
heard.
2. Per contra, Ld. Advocate holding for advocate on behalf
of defendant submit that matter before the Hon'ble High Court was

mentioned and it is likely to come on board in the last week of
November, 2022. Considering the submissions at bar, I find it proper
