Read application and say thereon. Heard both sides.
Perused record. Perusal of record shows that after giving sufficient
opportunity, as the defendants failed to cross examine PW1, as a last
resort, the impugned order came to be passed. However, as the
matter is still pending, in order to have the adjudication of the matter
on merits, it would be just and proper to give one more opportunity
to the defendants to conduct the cross-examination of the PW1 on
law points only, by imposing certain costs. Considering all these
aspects, application is allowed subject to costs of Rs.1000/-. The
defendants are permitted to cross examine the PW1 after compliance
of costs condition on next date without failure, failing which further
necessary orders shall be passed and thereafter, no further
opportunity shall be given under any circumstances.
