CNR No. MHSCA-3000103-2024
IN THE COURT OF SMALL CAUSES, AT MUMBAI.
(BANDRA BRANCH)
Order Below Exhibit 37
In
L.E. & C. Suit No. 8 of 2024
M/s. Hotel Imperial Palace (I) ….... Plaintiff.
V/s.
Finefoods Hospitality Private Limited …... Defendant.
Advocate for the plaintiff : M/s. Nankani & Associates
Advocate for the defendant : Mr. M. A. Chandan
Coram : K. M. Kayangude,
Judge, C.R. No. 38 (B.B.)
Date : 19.06.2024
Oral Order :
Perused the application and reply. Heard both sides.
2. It appears that there is a 10 days delay in filing the written
statement. Therefore, there is no any inordinate delay on the part of
the defendant. The reason put forth for the delay about the
unavailability of the documents seems to be just and proper. The suit is
in respect of immovable property involving valuable rights of the
parties. Therefore, in order to decide the matter on merits, it is
necessary to give fair chance to the defendant to defend the suit by
filing written statement. At the same time, the plaintiff can be
compensated by awarding appropriate costs. Accordingly, following
order.
