:: ORDER ::
This application is taken out by plaintiff to delete the name
of defendant No.2 from the title clause of the suit. It is contended that
after the report of bailiff he came to know that defendant No.2 who has
died however his legal heirs are already on record, therefore, the
plaintiff want to delete the name of defendant No.2.
2. Defendant No. 1 and 3 filed handwritten reply and
submitted that they have no objection.
3. Considering the reply of the defendant, it appears that the
legal heirs of defendant No.2 is already on record. Therefore application
deserves to be allowed. Hence, I proceed to pass following order :-
