In RAE Suit No. 203 of 2024, pending before the Court No. 32
(BB), the present applicant has sought his impleadment in the said
suit by moving an application at Exh. 13 which application was
rejected by the learned Trial Court by its order dated 17.09.2026 ,
against which the present revision application came to be filed.
2. This application at Exh. 15 is filed to bring the legal heir and
representatives of respondent No. 2 in the cause title of the
application. In para No.4 of the application the names of legal heirs
and representatives of respondent No. 2 are given.
3. Today, we heard learned Counsel for applicant/revision
Advocate Hasan Shaikh holding for the counsel for the applicant,
Advocate Manoj Badsiwal for the respondent No.1 and Advocate
Hasmukh Danewalla for respondent No. 3.
4. The learned counsel for respondent No.1 strongly objected
the present application mainly on the ground that date of death of
respondent No. 2 is not mentioned in the application. He further
submitted that death certificate is not annexed in support of the
contentions made in the application.
5. Perusal of the application shows that respondent No.2 died on
02.07.2026. This statement is made on oath. Therefore, we do not
find any substance in the objection raised by the learned counsel for
respondent No.1. Considering the nature of the application,
following order is passed.
