ORAL ORDER :
1. Perused the application and say filed thereon.
2. Heard both sides.
3. Present application is filed on behalf of police
department, Worli, Mumbai, for condonation of delay in deposit of
the deducted amount of Rs.15,000/- per month from June 2024 to
January 2025 from the salary of Smt. Jyoti Nivrutti Gaikwad
amounting to Rs.1,05,000/- and permission to deposit the said
amount into the Court by way of cheque bearing No.000223 dated
11/2/2025. By way of this application it is contended that in
compliance of order of this Court, the police department is
depositing amount of Rs.1,05,000/- which is deducted from the
salary of Smt. Jyoti Nivruti Gaikwad who is defendant in this
execution proceeding. Therefore seeking permission for depositing

the said amount into the Court.
4. On the other hand, plaintiff by filing reply simply
resisted the application and contended that I leave it to this Court
and may be permitted to the plaintiff to withdraw the same.
5. After hearing both sides, gone through the contents of
the application and reply filed thereon, also gone through the record
of the proceedings, by way of this application it is contended by
police department, Worli, that the amount of Rs.75,000/- deducted
from the salary for the month of June 2024 to November 2024 from
the salary of Jyoti Nivrutti Gaikwad mistakenly deposited in Police
Commissioner, Chamber No.13 (Police Welfare Scheme), Brihan-
Mumbai. Now the police department, Worli, Mumbai is depositing
the amount of Rs.1,05,000/- by way of cheque into the Court, in
compliance of the order of this Court. Hence, I proceed to pass
following order.
ORDER
1. Application is allowed.
2. Police Department, Worli, Mumbai, is
permitted to deposit the amount of
Rs.1,05,000/- (Rs. One Lakh Five Thousand
only) which is deducted from the salary of
defendant Smt. Jyoti Nivrutti Gaikwad, into
the Court.
3. The plaintiff is at liberty to withdraw the
amount deposited by the police department.
