ORAL ORDER :
Today also, the plaintiff and its advocate absent though
called out repeatedly. Perusal of record shows that the plaintiff has
filed affidavit of examination-in-chief of its authorised signatory on
26.10.2021. Thereafter, the admissibility of documents came to be
decided on 04.08.2023. However, thereafter, as the witness of
plaintiff failed to face cross-examination, by order dated 20.03.2024
below Exh.15, the evidence of plaintiff came to be closed and
thereafter, the matter was posted for dismissal order. However,
thereafter, the plaintiff has not appeared nor has taken any effective
steps towards prosecution of this matter further. This conduct of
plaintiff itself shows its total disregard and loss of interest. In these

circumstances, there is no alternative than to dismiss the matter.
Consequently, the matter stands dismissed for want of prosecution.
