Read the application moved by the insurer for
condoning the delay caused for filing Written Statement on
record and for taking the written statement on record.
2. The Ld. Advocate of applicant has objected for
allowing the application.
3. Considering the contentions in the application, it
cannot be disputed that the reason mentioned by the insurer
that some time is consumed in finalising the Written
Statement on getting investigation report is cogent one. On
gone through the proceeding, it is transpired that notice was
served upon the insurer on 10/11/2025 vide Ex.9. Thus, there
is inordinate delay near about 9 months. The said delay is not
satisfactorily explained. Therefore, I pass the following order.
ORDER
1. The application is allowed subject to payment of cost of
Rs.700/- to District Legal Services Authority.
2. The insurer do comply condition of cost on or before
next date.
