1. The record shows that since 08.07.2024 the
applicant and counsel remained absent and steps not
taken against the opposite party/owner of offending
vehicle. On 20.09.2025 advocate for applicant
remained present, however, steps not taken.
Thereafter, applicant and counsel remained absent. Till
today steps are not taken against the owner of the
vehicle. If case dismissed against the owner of vehicle
and tried against the insurer, definitely it would be bad
for non-joinder of necessary party. Since beginning,
applicant absent, therefore, considering these facts, I
am satisfied that the applicant is lost his interest or he
is negligent. Hence, application is hereby dismissed in
default.
